Punishment vs. Rehabilitation

As I said I would yesterday here is my piece about 13-year-old Christian Fernandez, who faces life imprisonment for murder and sexual abuse of a minor. This story is a very complex one and I will try and explain it fully, so bare with me.
 
Christian Fernandez has been charged as an adult with first-degree murder of his 2-year-old half-brother and the sexual abuse of his 5-year-old half-brother. Reading further into this story, Fernandez's life is one full of mistreatment and neglect.
 
He was the child of a sexually abused 12 year old mother and grew up in his early years in motel rooms around the use and trade of cocaine in Southern Florida. Fernandez throughout his childhood was beaten severely by his step-farther and even sexually abused himself by a cousin. His abusive step-farther while under suspicion of these beatings took his own life. All this contrived to Fernandez growing up showing signs of his later actions, once telling a counsellor, "You got to suck up your feelings and get over it."
 
 
Fernandez is now a resident in Duval County, Florida, waiting trial on a case that could see him be given life imprisonment if found guilty of the first-degree murder charges. Complications have been raised over U.S. Supreme Court legislation passed in the summer that doesn't allow juvenile offenders to be imprisoned without the possibility of parole. 
 
There is a belief among some locals of the Jacksonville area that local State Attorney Angela Corey was wrong in trying Fernandez as an adult. Carol Torres, 51, a grandmother of a fellow student at Fernandez's former school has set up a facebook page in the boys support, championing Rehabilitation over persecution.
 
This whole story, while very sad, can be seen as a debate about nature vs. nurture. Basically this means the influence and relative importance of innate qualities verses personal experience in the formation of an individuals physical and behavioural traits. (Yes, that is a dictionary definition.) Fernandez is the case of someone who was born in hopeless conditions and is therefore a product of this. To play devil's advocate it can be argued that murder is murder and this child who has already shown himself as a sexual predator could harm others if not properly punished. I would say that while his actions were atrocious and must be punished, it is an infringement of justice to Fernandez (a victim himself) not to approach this case with rehabilitation in mind. Show me someone who has grown up in the conditions he has that wouldn't be left severely affected and changed by it. Is life imprisonment just for a child that has known nothing but suffering, despite the fact he has caused the suffering of others?
 
The thing I have failed to mention is that the mother of the 2-year-old child found it dying with a fractured skull and neglected calling an ambulance for 4-hours while texting around for advice and searching the Internet. She has been charged with aggravated manslaughter, to which she pleaded guilty which could give her a prison sentence of up to 30 years. This women, while obviously herself has grown up in equally horrific circumstances can not be forgiven for her blatant lack of compassion and responsibility in the protection of her child. It is stories such as this that can make abortion seem a compassionate option if in life the child will know nothing but suffering.
 
Well that's my view on this anyway, I know it is a very difficult topic and you may see me as a bit liberal, but I like a debate and this is what this is about. The World We Live In...

Is not a nice place, I've just found a very controversial topic about a 13 year old boy, who faces life imprisonment for murder. The story is quite harrowing and the crime very heinous, but you need to hear the whole story before you judge.
 
But, as it happens I'm not going to get into it today. I know, what a fiend I am. I will get it written tomorrow so you beautiful people can start a debate, that's a promise you can take to the bank. (Just remember that bankers are lying scallywags that ruin the world.) Nah, it will be here, I don't want to keep you fictional people in suspense much longer.

Lets do this...

Okay, news, news...I could attempt to go in head first straight into the deep end over the Anti-Islam film protests, but it is 1am and that is for another day or time. I think I will keep it light for the first true post and by light I mean super creepy stalker weirdness...

In the USA, South Carolina specifically (I checked and that makes everything I say from now on have some form of legitimacy) A man has been arrested after being found living in the crawl space of his ex-girlfriends house. The story goes like this...

A women had been hearing noises in her attic and actually saw some fingernails through her bedroom ceiling, as you'd expect she and her kids (Yes, five kids were terrified by this) were becoming equally suspicious and  scared as the sounds continued for two weeks. They at first thought an animal was caught up there and later they gave way rational thinking and even were beginning to believe that there could be a poltergeist. 

Anyhow, the women got one of her nephews to give it a look and what do you know, her former boyfriend who she hadn't dated for over a decade previous had made happy families with her insulation. (Ironically she had originally broken up with the man because he got involved in "pervy" crime, my mistake petty crime.) I know what your thinking. (I wonder if that rib joints still open?) Why would this bloke come back after a decade? Well ask and you shall receive. It turns out she had asked him to change her locks a year before the incident and it is presumed he must have kept a key. While this maverick for pervs everywhere was up there he spent his time sleeping on old coats, defecating in plastic soda cups and watching the aggrieved women through her ceiling gratings. (and people say romance is dead, hey ladies?)

The man I am actually surprised to read is still at large. So, you know lock you windows and doors or something. The family is apparently to scared to sleep in the own rooms and are occupying a make-shift camp in their living room. 

This story I'm afraid to say does not surprise me. Human are sick and twisted people and someone who seeks affection through stalking of this kind must be really sick and twisted. Did I mention this guy must be really sick and twisted, cause he seems pretty damn sick and twisted. I mean think of the children, oh the humanity. I don't know what else to say, pervs, be pervs, be pervs. They will always be there, you just have to hope it is when you are not. I'm just here to keep you a little informed. Be safe you beautiful people.

Welcome World...

Okay, so this is the first time I have done anything like this and I'm trying to figure where to go with it myself, so bear with me. The main reason I am having a go at this is boredom and that doesn't bowed well for either the longevity or quality of this little venture, so I implore you to turn back now. I'm serious I have heard good things about that rib joint you passed on the way here, maybe you should check that out. Still here? your loss. Anyways as you can already tell from that little non sequitur I'm not that funny so that will probably be avoided, well probably not...I mean I can't help myself.

Well in the time it took me to write that lot of drivel you just had the displeasure of reading I have had a little epiphany. (which by anyone else's reckoning would be described as an idea, but my hubris precedes me.) I think I will try a bit of social commentary, (yeah, yeah I know, yawn. Just bear with me) I will try and find a few random news stories that take my interest or a one big news story and give my totally biased and by no means applicable view on the issue. I (as most) like to think myself as some kind of deep enlightened thinker, when in reality I'm a bit of idiot at times (I mean the gaps in some areas of my knowledge is ridiculous). Still with me? or are those ribs starting to sound tempting?

Any who, that will probably do for my introduction. I suppose I should say some more about myself sometime, but all in moderation. I better keep these post short.
